In this country, the left has a totured interpretation of what constitutes equality. It is equal for some to pay more than others, for some to receive disparate government benefits while others don’t, and for some to get into a college based on race and others to get denied for the same reason. In essence to be treated equally, according to the left, is to be treated differently.
To reinforce my point, I have taken a quote from Justice Blackmun’s opinion in the 1978 affrimative action case Regents v. Bakke. Basically, the ruling from Bakke and the opinion of Blackmun is that, as a country, we need to discriminate with regard to race in order to end racial discrimination. Seems much to akin to what logicians call circular logic.
I suspect that it would be impossible to arrange an affirmative-action program in a racially neutral way and have it successful. To ask that this be so is to demand the impossible. In order to get beyond racism, we must first take account of race. There is no other way. And in order to treat some persons equally, we must treat them differently.
The times though, they are a changing….
In a recent affirmative action related case involving a Seattle school, Justice Roberts asserted this (quote below) as a mocking play off of Justice Blackmun’s famous quote (the famous part is in bold above):
the way to stop discrimination on the basis of race is to stop discriminating on the basis of race
No circles here. Just conservative common sense. I’m telling you, Roberts and Alito may be the best and longest lasting things Bush has, and ever will, do. It is widely expected both will be on the Court until many of us CRs are in our late 40s.
